These terms apply to services booked directly with Belle Balance where their application is agreed before the contract is concluded. They cover private and group sessions, yoga, Pilates, meditation, sound sessions, Thai yoga massage, Reiki, workshops, private celebrations, corporate well-being, events, retreat yoga packages and individually commissioned photography.

Individually negotiated agreements take precedence. These terms do not retrospectively change existing bookings. Consumer-specific provisions apply only to people booking predominantly for purposes outside their trade or profession.

When you book with a studio, hotel, university sports provider or other organiser as your contracting party, that provider's agreed terms apply. A link on this website does not make Belle Balance your contracting party for that provider's services.

2. Enquiries and contract formation

The website presents our services and invites enquiries. Clicking an email link, sending a place enquiry or requesting a waitlist entry does not create a paid booking or guarantee a place.

Following your enquiry, we agree the service, date or period, location, price and any further conditions with you. A contract is formed when you accept our binding offer, or when we expressly accept your binding booking request. An acknowledgement of receipt or a waitlist entry alone is not acceptance.

You receive the relevant terms and booking information before making a binding booking. For distance contracts, we also provide the contract confirmation and required information in a form you can retain, such as an email. Contracts may be agreed in German or English.

3. Services, prices and payment

The service description and agreements made when booking determine what is included. Prices quoted to consumers are total prices including any applicable taxes. Additional costs, such as separately booked accommodation or travel, are identified before you enter into the contract.

Payment methods, due dates and any deposits must be agreed before booking. If no payment date is agreed, the statutory rules apply. An invoice does not introduce additional charges or change the agreed conditions.

Early-bird rates depend on the conditions stated in the offer. Figures described as approximate on the website are estimates; the binding price is confirmed before booking.

4. Participation and well-being

Our movement, relaxation and bodywork sessions are well-being services, not medical diagnosis or treatment. A particular health outcome is not promised.

Please practise within your personal limits, follow safety instructions and stop an exercise if you experience discomfort. If you are unsure whether an activity is suitable for you, seek appropriate medical advice beforehand. Discuss any necessary adjustments with us before the session; detailed medical records are not required for a booking enquiry.

Participation by minors requires the necessary consent of their legal representative and prior agreement about the suitability of the activity. These participation guidelines do not exclude or limit our statutory duties or liability.

5. Retreats and third-party services

The retreat description and your booking agreement identify the services provided by Belle Balance. Where a yoga package and accommodation are offered separately, each service, price and contracting party must be clear before booking. A yoga-package enquiry alone does not reserve a room.

For the Neue Regensburger Hütte retreat, you organise your own travel and ascent; the retreat begins at the hut. Optional hikes are undertaken independently unless a guided activity has expressly been agreed. Luggage transport must be arranged in advance and is not automatically included.

Where accommodation or other services are genuinely booked directly with an independent provider, cancellation and payment questions about those services must be addressed under that separate contract. Merely describing services as separate does not remove mandatory package-travel or linked-travel protections. Any such protections that apply to the actual booking remain unaffected.

6. Photography and use of material

For photography commissions, we agree the scope, delivery, remuneration and permitted uses of the images in the individual offer. Statutory rights concerning defects remain unaffected. Further rights of use are not granted merely by displaying photographs on this website.

Permission to publish identifiable photographs or recordings of participants is handled separately where required. Accepting these terms does not itself grant consent to advertising use of your image or to newsletter marketing.

7. Cancellation, changes and unavailable services

Please contact us as early as possible if you cannot attend. Rescheduling or substituting a participant requires agreement, without prejudice to any statutory right to transfer a booking.

Any special cancellation conditions must be validly agreed before booking. Otherwise, the statutory rules govern cancellation, termination, non-attendance and any payment still due. Any expenses saved or alternative earnings must be taken into account where the law requires. These terms do not introduce a flat-rate cancellation fee.

If we cannot provide an agreed service, we will inform you promptly. A replacement date or materially changed service requires your agreement. Where the service is cancelled without an agreed substitute, amounts paid for the service not provided will be refunded promptly. Your further statutory rights remain unaffected.

These arrangements do not restrict a statutory right of withdrawal or termination for good cause.

8. Consumer withdrawal rights

When a right of withdrawal applies

Consumers generally have a statutory right to withdraw from distance and off-premises contracts. Under Section 312g(2), number 9 of the German Civil Code (BGB), an exception applies to leisure services agreed for a specific date or period. This can include a dated yoga workshop or retreat yoga package. It does not automatically apply to every service we offer. Before booking, we inform you whether an exception applies to your particular contract. Mandatory special rules, including those for package travel, remain unaffected.

Withdrawal information for service contracts with a right of withdrawal

You may withdraw from the contract without giving a reason within 14 days of its conclusion. The period does not start before you have received the legally required withdrawal information.

You can use the sample form below, but do not have to. Sending your notice before the period expires is sufficient.

What happens after withdrawal

We refund payments received under the contract without undue delay and no later than 14 days after receiving your withdrawal notice. This includes any standard delivery costs; additional costs for a more expensive delivery method chosen by you are excluded. We use the original payment method unless expressly agreed otherwise, and charge no refund fee.

If you expressly requested the service to start during the withdrawal period, you may owe a proportionate amount for the service supplied up to withdrawal. This applies only if the statutory information and consent requirements have been met. The amount is based on the agreed total price, or on the market value if that total price is disproportionately high. For an off-premises contract, your request must be made in a form that can be retained.

Early completion of the service

For a paid service, the right of withdrawal ends on full performance only if, before performance began, you expressly agreed to an early start and acknowledged that full performance would end that right. For an off-premises contract, the consent must also be provided in a form that can be retained. Acceptance of these terms alone does not give that consent.

10. Liability

Our liability is governed by the statutory provisions. These terms do not exclude or limit liability for personal injury, deliberate or negligent breaches of duty, or other liability imposed by law. References to independent participation, travel or hiking do not remove your statutory rights.

12. Dispute resolution and remaining provisions

We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.

The applicable law and competent courts are determined by the statutory provisions. These terms do not impose an exclusive place of jurisdiction or remove mandatory consumer protections. If a provision is ineffective or has not been incorporated into the contract, the statutory rules govern its consequences.
